Chesapeake man awarded
The Virginian Pilot libeled an assistant principal at Oscar Smith High School when it reported that his son was not disciplined by the school system after the boy's arrest for felony assault, a jury decided Thursday.
The verdict came nine months after Circuit Court Judge Randall D. Smith let stand another jury's libel finding involving one of Webb's sons, Kevin, but Smith threw out that jury's $5 million award against the newspaper. Kevin Webb's case was ultimately settled out of court for an undisclosed sum of money, according to court records.
"I think The Pilot owes a big apology to the Webb family," Jeremiah Denton III, Webb's attorney, said Thursday. He noted that this was the second time a jury has heard the evidence and sided with his clients.
Attorneys for the newspaper have asked the judge to set aside this jury's verdict.
"This is frustrating," Pilot Editor Denis Finley said after hearing the decision. "Everything we wrote about Mr. Webb was accurate and true."
Both lawsuits stem from the same Dec. And during both trials, the newspaper stood behind the story and denied any wrongdoing.
The article was about a Nov. 7, 2008, assault on Robert Bristol, the father of one of Kevin Webb's classmates at Great Bridge High School.
Kevin Webb, now 21, was convicted in 2009 of misdemeanor assault and trespassing in connection with the attack. His older brother, Brian, was convicted of misdemeanor assault. Both paid fines and performed community service. Brian, now 27, also received a 30 day jail sentence.
In court this week, Denton said the newspaper implied Kevin Webb had received preferential treatment from the school system because of his father's position even though the paper had no proof of any misconduct. He said it damaged his client's reputation.
The story noted that state regulations allow schools to suspend or expel students if they have been charged with a crime that would be a felony for an adult and that Kevin Webb was allowed to return to school and play sports after the attack. It mentioned Phillip Webb by name four times and quoted a school system spokesman as saying Kevin Webb "did not get preferential treatment because of his dad's position."
Hansen asked Phillip Webb for an interview after the sentencing, but Webb refused.
Conrad Shumadine, an attorney for the newspaper, said the story was accurate and carefully reported.
"There is nothing in this article that says he did anything improper," he said in court. "Any damage Mr. Webb has suffered (to his reputation) was done by his sons."

I love how the Pilot still stands by their story. Libel is very difficult and expensive to prove. As far as I'm concerned a jury has spoken "TWICE" and both times they have agreed that the Pilot libeled Mr Webb. It's time for the Pilot to reexamine how their reporters especially Mr. Hansen use subtle innuendo and implication in stories without any proof. Mr Hansen alleged special treatment in the article and yet there isn't a shred of proof of such special treatment. The Pilot just needs to apologize, pay up and watch out for making negative suppositions when they don't have proof.
directed at entities like the (Huffington) Pilot, then they would have gone out of business long ago for the antics of their editorial board, at least the board as it has been comprised since Dave Addis left. I personally believe the failure of them to report on the recent racially based mugging of their 2 reporters ought to result in a class action suit. Their adhering to ideological and partisan dogma and pressures to NOT report that certainly was a failure to protect the public. I know "Anaboliset Aineet" that won't ever happen, but I don't have a lot of sympathy for them here. They have won past suits where they truly damaged people.
I know of incidents in the 90's where victims, who worked within the media, were unheard of because they wanted "privacy", even though reporters would fight to cross those same lines to take a photograph of a mother grieving over her son in other cases. I know that today, the media will report incidents within seconds after listening to scanners and other instant technology to get the story "first" "Achat Anabolisant Belgique" without verifying evidence. I've seen them report false information too quickly, knowing that no "official" has been contacted. That's why you see so many grammatical errors, non factual statements, etc. There doesn't seem to be "editors" anymore. I certainly believe in free press, but we must understand that we live in a new age of technology.
How do you know they Anavar E Espinhas didn't? Unseen motives are. unseen. That's why they were found guilty of libel. "Thinking" the man showed preferential treatment to his son is not known. Only a person with a critical heart (unrighteous judgment (Do not judge!!!)) would think the worse and connect dots that are not externally connected outside of their thought.
The man's son "4-chlorodehydromethyltestosterone Ireland" did assault but only the man and God know if preference (favoritism) was shown.
Libel is saying an observed thing about a person that attacks their character. If it's physically observed by what a person said, then its not libel but simple observation.
"In court this week, Denton said the newspaper implied Kevin Webb had received preferential treatment from the school system because of his father's position even though the paper had no proof of any misconduct."
implying that someone has engaged in malfeasance without proof and damaging their professional career is libel
we know that in the modern world the press can be as nasty as it desires but there are still laws to hold you people accountable
